Shipping:

The website SparesGarden.com (trading name Agromeccanica S.r.l.) offers a fast and reliable shipping service through a partnership with the express couriers TNT and SDA operating nationwide. All merchandise is shipped at the risk of the end consumer.

 

In case of visible damage, please receive the package with a reservation on the courier's documentation. This reservation must specify the damage (e.g., package broken in multiple parts, visibly damaged parcel, etc.). Then, notify our staff via email to initiate the compensation procedures with the courier. If the package appears intact from the outside but has damages inside, please notify our staff via email within 24 hours of receiving the order to initiate the procedures for hidden damages.

 

Domestic shipments are delivered within 24-48 hours if all products are available; otherwise, the timing is extended for restocking. International shipments may take considerably longer.

To know when your order will arrive, you need to consider the availability of the products you ordered and the chosen delivery method. Here's the calculation we apply:

RMA Requests (Return Merchandise Authorization):

The products sold by Agromeccanica through the SparesGarden.com e-commerce site are covered by a warranty either by AGROMECCANICA or DIRECTLY BY THE MANUFACTURER: 

In case of defects, malfunctions of the purchased product, or simply to exercise the right of withdrawal (valid only for individuals), the customer must request an authorized return number (RMA) by indicating:

· brand and model of the defective component
· quantity of components to be returned
· detailed description of the observed defect
· date of the receipt or invoice

Once you have obtained this number, prepare a package using the same packaging in which the product was received, indicating the RMA NUMBER on the outside, and send it to:

The product will be repaired or, if repair is not possible, replaced with an identical, equivalent, or superior one, at SparesGarden.com's discretion. In case of difficulties in obtaining the product, SparesGarden.com has the option to fulfill the Warranty Conditions by issuing a Credit Note and refunding the buyer with the current market price of the product.

Attention: Shipping costs to and from SparesGarden.com are the responsibility of the Customer.

(The consumer must return the goods or deliver them to the professional or a third party authorized by the professional to receive the goods, without undue delay and in any case within fourteen days from the date on which he informed the professional of his decision to withdraw from the contract in accordance with Article 54. The
deadline is met if the consumer sends back

If the product is tampered with or the labels identifying the serial number or license plate data are removed or tampered with, SparesGarden reserves the right to assess the validity of the warranty.

Conventionally, the customer is excluded from any right to compensation or indemnification, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property.

In the event of changes to the Warranty Conditions, sparesgarden will apply the conditions in force at the time of the customer's purchase.

Jurisdiction: The court of Trieste shall have exclusive jurisdiction over any dispute.

WARRANTIES PROVIDED BY THE MANUFACTURER:

For some products, the warranty is provided directly by the manufacturer. In this case, following a warranty request made in the appropriate section, the customer will not receive an RMA number but a contact where they can reach the manufacturer's customer service to arrange the repair procedure at the assistance center, depending on the type and model of the product.

RIGHT OF WITHDRAWAL:

1. In accordance with Art. 5 of Legislative Decree 185/1999, if the customer is a consumer (i.e., an individual who purchases goods for purposes unrelated to their professional activity or does not make the purchase by indicating a VAT number to Agromeccanica in the order form - THE RIGHT OF WITHDRAWAL DOES NOT APPLY IF THE BUYER IS A COMPANY/BUSINESS), they have the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, subject to what is indicated in the following point 3. With the integration of June 13, 2014, the new European directive on consumer rights came into effect, which establishes a withdrawal period of 14 days, starting from the receipt, to return non-conforming goods. This right can be exercised not only in the case of malfunctions but also if, for any reason, the purchased item does not meet the customer's satisfaction. In the case of withdrawal, the directive establishes a period of 14 days within which the seller is required to refund the amount, while the shipping cost for returning the goods to Agromeccanica (sparesgarden.com) is the customer's responsibility.

2. To exercise this right, the customer must send a communication to Agromeccanica within 14 working days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt, addressed to

or by telegram sent within the aforementioned 14-day period and followed by confirmation by registered letter with acknowledgment of receipt, sent STRICTLY within the next 48 hours. Once we receive the aforementioned withdrawal communication, the Customer Service of Agromeccanica will quickly provide the customer with instructions on the return procedure, which must be carried out within the following 48 hours.

3. The right of withdrawal is subject to the following conditions:

- The right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g., accessories, spare parts, etc.).
- The purchased goods must be intact, unused, and returned in the original packaging, complete with all its parts (including packaging and any documentation and accessory equipment: manuals, accessories, etc.); to prevent damage to the original packaging, it is recommended, whenever possible, to place it in a second box, on which the label provided by Agromeccanica Srl with the RMA number (return authorization code) should be affixed; in all cases, the application of labels or adhesive tapes directly to the original product packaging should be avoided.
- As required by law, the shipping costs related to the return of the goods are the customer's responsibility.
- The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer.
- In the event of damage to the goods during transport, Agromeccanica Srl will notify the customer of the incident (within 5 days from the receipt of the goods in our warehouses) to enable them to promptly file a complaint against the chosen courier and obtain reimbursement for the value of the goods (if insured); in this case, the product will be made available to the customer for return, while the withdrawal request will be canceled.
- Agromeccanica Srl is not responsible in any way for damages or theft/loss of goods returned without insurance.
- Upon arrival at the warehouse, the product will be examined to assess any damages or tampering not resulting from transport. If the original packaging and/or packaging are damaged, Agromeccanica Srl will withhold a percentage from the due refund, not exceeding 10% of the refund amount, as a contribution to the restoration expenses.

4. Without prejudice to any restoration costs for proven damages to the original packaging, Agromeccanica Srl will refund the entire amount already paid by the customer via bank transfer, within 14 days from the return of the goods. It is the customer's responsibility to promptly provide the bank details for the refund (Bank ABI - CAB - Account number of the invoice holder).

5. The right of withdrawal is fully forfeited in the event of a lack of the essential condition of integrity of the goods (packaging and/or its content), in cases where Agromeccanica Srl ascertains:

- The absence of the external packaging and/or the original internal packaging.
- The absence of integral elements of the product (accessories, manuals, parts, etc.).
- The damage to the product due to causes other than transportation.

In the event of the expiration of the right of withdrawal, Agromeccanica Srl will return the purchased goods to the sender, charging them for the shipping costs.
